These general terms and conditions of sale govern the offer and sale to the consumer and/or professional buyer of products and/or services branded Alessi Firenze srl made by the buyer through the Internet on the website www.emilianoalessi.it
For sales in Italy to the consumer will be applicable D. Lgs 206/205 (consumer code), for sales abroad any other regulations if they exist.
The Customer declares by validating the order that he/she has accepted these GTC and adheres to them.

Terms of sale

1. Contractual parties
The contractual parties for the sale of the products on the site and viewable online at www.emilianoalessi.it are:
– Company Alessi srl Firenze srl with sole shareholder, based in Campi Bisenzio (FI), via Della Prunaia 209 Int. 3 (tax code and VAT number 06966290485)
– the final consumer, i.e. the natural person who buys through the site for purposes unrelated to commercial, entrepreneurial, craft or otherwise professional activity; the professional, natural person or legal entity that buys with invoicing with or without VAT number.
Depending on the type of customer (consumer or professional) different rules and conditions of sale may apply.
Sales and deliveries are made within the territory of Italy, other European countries, the United States OF America and other countries in North America.
When placing an order, the customer must declare that he or she is of legal age and has read these terms and conditions of sale and payment, as well as all the information provided during the procedure, together with the privacy policy and information on cookies.

2. Conclusion of the contract
The customer can purchase the products in the electronic catalog of Alessi Firenzer srl Unipersonale at the time of placing the order and viewable online at the web address www.emilianoalessi.it as described in the relevant information sheets also indicating the price (including vat and / or other taxes and fees), terms and methods of payment and delivery. Once the selection has been made, the customer validates the shopping cart and chooses one of the payment methods.
Verified the availability of the product and at the outcome the correct receipt of the order will be confirmed by the seller by email sent to the email address provided by the customer.

The seller reserves the right not to process incomplete, incorrect orders, as well as in the event of unavailability of the ordered product or if the regulations in force in the country of shipment prohibit or restrict the export of certain products (in which case the seller shall inform the customer without delay that the contract has not been completed, specifying the reasons). In such circumstances the contract will not be completed, or, if completed, will be considered terminated and no amount will be due from the customer and any payments made will be returned. Seller’s liability for damages to persons or property for failure to accept an order or failure to complete or terminate the contract for the above reasons is expressly excluded.
Invoice will be available upon Customer’s request.

3. prices and method of payment
Products are offered at the price (including taxes and vat) and shipping costs shown on the site at the time the order is placed. For Italy the price is in euros (€), for other countries the price may differ depending on the country of shipment taking into account any local taxes.
The following payment methods are provided:
By credit card. All credit cards belonging to the VISA, MASTERCARD, MAESTRO, AMERICAN EXPRESS, and CB circuits are accepted. Withdrawal of the amount will occur when the transaction is completed and a notification email is sent to the customer’s email address. In case of order cancellation, the amount will be refunded to the customer’s bank account.
Via Paypal. The customer will be able to complete the payment directly to their Paypal account. The amount related to the order will be charged to your Paypal account when the order is taken. In case of order cancellation, the amount will be refunded to the customer’s Paypal account.

4. Shipping and delivery
Orders will be processed from 9.30 a.m. to 5.00 p.m. Monday through Friday.
Products will be delivered by courier to the address indicated in the purchase order approximately within 48 hours after the conclusion of the contract (72 hours for islands). For all other countries, delivery times will be indicated on the site depending on the individual state and the means of transportation used by the carrier.
In Seller shall not be liable for any delays due to causes beyond its control.
The Courier will be responsible for delivery.
At the time of delivery, the Customer is required to check the contents of the package, objecting any reservations for defective or damaged products on the delivery note provided by the carrier and notifying the company Alessi Firenze srl Unipersonale at the email address ordini@emilianoalessi.it , attaching photographic material certifying the originality of the packaging and products received.
At the time the package is given to the courier, the customer will receive an email containing the tracking link.
Delivery to Italy is free for orders over €85.00 (eighty-five//00), below that amount the shipping cost to Italy is €12.00 (twelve//00).
For shipping costs to other countries, the Customer can view the shipping rates in effect at the time of the order at www.emilianoalessi.it .

5. Right of withdrawal (for consumers only)
The consumer has the right to withdraw from the contract by notice, which must contain all the details of the contract, to be sent by registered letter with return receipt to the address via della Prunaia 209 int.3 50013 Campi Bisenzio Florence or email address alessifirenze@pec.it to be sent no later than 48 hours as per art. 52 D. Lgs 206/2005.
The cost of returning products to the Seller will be borne by the consumer.
Essential condition for the exercise of the right of withdrawal is the integrity of the product.
The right of withdrawal is not allowed for orders with customizations.

6. Free return and exchange
It is permitted to make a contextual exchange or return of the goods, within 48 hours of delivery, but the transportation costs for return and reshipment to be borne entirely by the buyer, except for any defects and/or faults in the goods.
Conditions for exchange and return:
Goods must not be broken, deteriorated, or show signs of wear and tear from use.
If the material is packaged, the packaging must be reused to reinsert the goods.
In the case of food products, bottles, jars and pouches must not have been opened.
Labels or tags should not be removed or damaged.
The above daily deadlines shall not have elapsed from the date of receipt of the goods

7. Applicable Law and Competent Court
The conditions of sale and all contracts concluded on the basis of them are governed by Italian Law.
The exclusive competent Court for the resolution of any dispute arising out of or in any way connected with these conditions of sale and/or the contracts of sale should arise between Seller and Professional will be that of Florence, with the exclusion of any other Court.
The competent Court for the resolution of any dispute against the Consumer will be that provided for by the Italian legislation in force at the time of the conclusion of the contract.
